The PEXA settlements hack made headlines recently, when a fraudster was able to gain access to the online system and steal $250,000 of a vendor's settlement funds. What is PEXA and electronic conveyancing?
PEXA is Australia's new online property exchange network. It was designed to facilitate the settlement process to become more reliable, streamlined and effective. In many ways, this has been successful. In our experience, we have found that PEXA settlements are more likely to settle on time and with minimum fuss.
In Victoria, all settlements will be completed electronically via PEXA by 1 October 2018.
Is there a risk to my settlement money?
In the case recently reported in the media, $250,000 was stolen from a couple's settlement funds after the sale of their property was completed. This money was held by a conveyancing company. The hackers were reportedly able to access the system through the conveyancer's emails, reset the password and reroute the payment to their own bank account.
To minimise this risk at Sharrock Pitman Legal, we ensure that all settlement funds are directed to our trust account, which we will then disburse to you. Our Finance team undertake rigorous daily checks as to possible irregularities with any financial transactions. We also have a minimum of two lawyers (including one principal lawyer) who will check the bank account details before any settlement can proceed. With this strict procedure, there is no possibility that any changes to bank account details will go unnoticed. PEXA has also developed additional alerts and processes to further enhance security in the system.
